Who You Are
Contracting With
One practitioner, named on the invoice and present in every conversation.
Swagia is the working name of Bingi Conny, an independent digital marketing strategist based in Dubai, United Arab Emirates. There is no agency structure behind it: when you engage Swagia you are engaging me personally, and the work is not passed to a junior account handler after the first conversation.
These terms cover two separate things. First, your use of this website, which you accept by browsing it. Second, the standing terms behind an engagement — which apply alongside the written scope or proposal for your specific project. Where the two disagree, the signed scope wins; these terms fill in whatever it does not cover.
How the Work
Is Agreed and Paid
Nothing starts until the scope is written down and you have agreed to it.
Scope
Every engagement begins with a written scope covering what is being done, what is being reported and what it costs. Work outside that scope is quoted before it starts rather than added to an invoice afterwards. If the plan changes mid-way because the data says it should, the change is agreed with you first.
Fees
Engagements are billed as a flat monthly fee rather than as a percentage of your media spend, so what I recommend you spend is never tied to what I earn. Fees are invoiced monthly in advance unless the scope says otherwise. Current scopes and indicative ranges are published on pricing.
What fees exclude
- Advertising spend of any kind, which you pay directly into your own accounts.
- Third-party software and platform subscriptions, billed in your own name.
- Paid placements or sponsored links, which I do not buy on your behalf.
- Major site rebuilds or custom development beyond what the scope describes.
Term and ending an engagement
Three months is the minimum I recommend, because that is roughly how long it takes to implement, test and optimise before the numbers mean anything. Beyond it there is no long-term lock-in and no notice period designed to make leaving awkward. Either of us can end an ongoing engagement by telling the other in writing; work already delivered and the month in progress remain payable.
What you are responsible for
- Access to the accounts, analytics and past reporting the work depends on.
- Reviews and approvals within the agreed timeframe, since delays move the timeline.
- The accuracy of the claims, prices, offers and assets you ask me to publish.
- Holding the licences and permissions for any material you supply for use.
- Meeting the platform policies and local advertising rules that apply to your sector.
Ownership of accounts and assets
Advertising accounts, manager accounts, analytics properties, tag containers and creative assets are set up in your name and stay in your name — I work through partner or delegated access. Deliverables produced specifically for you become yours once they are paid for. If we stop working together, nothing has to be rebuilt and no data is held back.

Marketing outcomes depend on your market, your offer and platforms neither of us controls.
No guaranteed results
I do not guarantee search rankings, lead volume, revenue or any specific performance figure, and you should be sceptical of anyone who does. Search engines and advertising platforms control their own results and change their systems continuously. What is committed to is the work described in the scope, done properly, reported honestly, and stopped or changed when the data says it is not working.
Third-party platforms
Work is carried out inside platforms run by other companies, each with its own terms, policies and approval processes. Account suspensions, policy changes, pricing changes and outages on those platforms are outside my control, and I cannot be responsible for them beyond doing the work needed to respond.
This site and the free tools
The articles, benchmarks and calculators published here are general information for planning, not advice for your specific situation, and not financial advice. The tools work from the figures you type in and produce estimates rather than forecasts. Decisions you take from them are your own. Where a third-party benchmark is quoted anywhere on this site, its source is named so you can check it yourself.
Liability
To the extent the law allows, my liability arising from an engagement is limited to the fees you have paid me for the part of the work the claim relates to, and does not extend to lost profit, lost revenue or indirect losses. Nothing here limits liability that cannot lawfully be limited.
Confidentiality
Confidentiality runs both ways. Your spend figures, account data, commercial terms and anything strategic stay between you and me, and a mutual non-disclosure agreement can be put in place before anything is shared. I will not name you as a client or describe your work publicly without your agreement.
Intellectual property
The writing, structure and design of this website are mine and are not licensed for republication. Methods, templates and internal tooling I bring to an engagement stay mine; the work produced for you under a paid scope becomes yours on payment, along with the right to keep using it after the engagement ends.
Governing law
These terms are governed by the laws of the United Arab Emirates, and any dispute neither of us can settle directly is subject to the courts of Dubai. The sensible first step is always a conversation.
Changes to these terms
These terms can be updated, and the date at the top changes when they are. A change does not alter a scope already agreed with you — that keeps the terms in force when it was signed. How personal data is handled is set out separately on privacy.
